House passes small-business friendly LLC modernization
The New Hampshire House demonstrated its small-business “cred” by passing SB 203 with a 172-106 roll call vote. A top legislative priority of the BIA, SB 203 modernizes New Hampshire’s dated LLC statutes and provides small business with a host of new protections and guidelines designed to help them prosper and grow. Throughout the legislative process, SB 203 benefited by having strong bipartisan support and it was able to avoid non-germane amendments being attached (an attempt made yesterday to add an amendment exerting legislative control over the supreme court failed 125 to 159). Representatives Dave Hess (R-Hooksett), Norm Major (R-Plaistow) and John Hunt (R-Rindge) led the floor fight defending the pro-business legislation.
SB 203 has been characterized as giving New Hampshire the best LLC Act in the country, and many have described it as the most important small business bill to be considered by the legislature in years. On behalf of our many small-business members, and the thousands of New Hampshire small businesses that are a part of our Capitol Connect program, BIA is proud to have worked so hard developing the language and guiding the bill through the legislative process. But the bottom line is, it takes pro-business legislators to recognize the merits of a bill and to vote in favor of it. NH Senate Rescues Research & Development Tax Credit
SB 295, another top legislative priority of the BIA began in the Senate by doubling the annual state investment in R&D tax credits from $1 million to $2 million and repealing the July 1st, 2013 sunset of the program. Like SB 203 this bill had strong bipartisan support and passed the Senate unanimously. However, the House added a non-germane amendment to the bill requiring a 24-hour waiting period before an abortion could be performed. This controversial “social issue” language had already been defeated by the Senate. Following this action, the House sent the bill to the Finance committee for further work. To its credit, the Finance committee retained the repeal of the sunset date, but removed the abortion related language. They also removed the increase in state investment, but at least the full House would be able to once again vote on a “clean” R&D tax credit bill. The House however promptly added the non-germane abortion language back onto the bill, creating a showdown with the Senate over a tax credit that is critical to New Hampshire’s advanced manufacturing and high technology community.
But a showdown only happens if both sides show up for the fight.
Someone reminded the Senate they had an old House bill carried over from last session, HB 518, on the table. HB 518, which also dealt with R&D tax credits, had become “obsolete” once SB 295 was drafted and introduced. Well, what’s old became new. The language of HB 518, which extends the R&D tax credit sunset date from 2013 to July 1st of 2015, is certainly an inferior bill to the original version of SB 295. But taking HB 518 off the table and passing it with no changes, which is precisely what the Senate did, cleverly avoids a confrontation with the House over controversial and sensitive abortion language. HB 518 now goes to the Governor for his signature. As for the fate of SB 295, which in its original form doubled investment in the R&D tax credit to $2 million and eliminated the sunset date? The BIA will queue it up again next year when hopefully cooler heads will prevail.

The House and Senate spent the past two weeks burning through legislation trying to out-maneuver each other and find a vehicle to attach language clarifying that the communications service tax (CST) does not apply to the internet. First, the language was attached in the Senate to HB 1652. The House opted to kill that bill because of a disagreement in another section of the legislation over how to apply a projected budget surplus. The House then quickly attached the CST language to SB 399, which passed the House with provisions relating to rulemaking of business tax forms, which the Senate and BIA oppose. The Senate seeing this action then attached the CST language onto HB 1418, which now heads back to the House for concurrence. Still with us? The bottom line is making sure that New Hampshire does not tax access to the internet, a priority for the BIA. Our hope is whatever vehicle is chosen, both chambers are able to reconcile their differences.

Can you hear me now?
Both the House and Senate should be taking a victory lap this week for passing SB 48, a bill that will deregulate retail telecommunications services in the state. SB 48, a pro-business and pro-consumer bill backed by the BIA, will create a level playing field amongst all telecommunications providers in the state and spur greater competition. This should lead to reduced rates and help foster greater innovation and broadband expansion in the state. With the House passing SB 48 this week, all that remains is Governor Lynch’s signature.
