This Week's Top News
A silver lining, with plenty of dark clouds
The New Hampshire House and Senate met in a one-day special session to pass legislation to close an estimated $295 million gap in the biennial budget. The good news for the business community is that new taxes and fees that had at one time been very much a part of the discussion were not included in the final compromise package. Gone were proposals such as the estate tax and a new tax on electricity generation. Also scrubbed from the final bill were proposals to give municipalities the ability to enact “local
option” rooms and meals taxes and increases to the insurance premium tax.
Although the business community, for the most part got through this budget crisis unscathed, the future is not at all rosy. Critics of the budget bill are skeptical that revenue estimates are accurate and absent more significant budget cuts, we will once again be facing huge deficits. Others point to the revenue from future sales or leasing of state assets to be “phony revenue” since there is no guarantee that whatever assets are sold will bring in the revenue expected. And finally, everyone recognizes that the
last budget was bailed out with hundreds of millions in federal stimulus spending that won’t be available next time. The bottom line? As difficult and unpleasant as this legislative session was, look for 2011 to be even worse.
Gone, but hopefully not forgotten
One of the highlights of the budget bill passed on Wednesday was the repeal (finally) of the extension of the interest and dividends tax to distributions from LLCs and partnerships. The BIA and others had turned up the heat on this issue to the point that the House and Senate had separate stand-alone repeal bills available to use if the omnibus budget bill, which contained identical repeal language, was defeated. As it turned out, the “backup” bills were not necessary and with the governor’s signature,
the controversial tax from the 2009 session will soon be nothing more than an unpleasant memory. We hope that a lesson has been learned from all of this about what can happen when complex issues, especially tax proposals, are passed at the last second without proper consideration and input from the public.
The impenetrable wall penetrated
The Greenhouse Gas Emissions Reduction Fund, which accrues to the state from the auctioning of CO credits as part of the Regional Greenhouse Gas Initiative and which, by design, was supposed to be available for businesses and residential energy improvement projects, was raided to the tune of $3.1 million to help bring the budget into balance. Were we happy over this? Not at all, but we were not exactly surprised either. During the legislative debate over implementation of RGGI two years ago, BIA warned that such
a fund would be a tempting target for future legislators whenever quick cash was needed to balance the budget. Strong supporters of RGGI at that time claimed to have built an “impenetrable wall” around the fund and that BIA’s concerns were alarmist. Guess who’s alarmed now?
So long, farewell, Auf Wiedersehen, adieu

A big-city counterfeiter decided the best place to pass off his phony $18 bills would be in some small "hick town." So, he got into his very expensive new luxury car and off he went.
After driving for a while, he found a tiny town with a single store. He entered the store and handed one of the bogus bills to the man behind the counter. "Can you change this for me, please?" he asked.
The store clerk looked at the $18 bill for a short time, then smiled and said to the man, "Ah reckon so, mister. Ya want two nines or three sixes?"
